3. Use of the Website

You may use our Site for lawful, personal, and non-commercial purposes. You agree not to:

4. SMS / Text Messaging Terms

These terms apply to text (SMS) messages sent to and from our main business number, 530-878-5022. They do not govern day-to-day project communication you may have by text with individual team members from their mobile phones during your project.

Brand Name. SMS messages sent through this program are sent by Innovative Stone.

Program Description. Our main business number SMS program is used primarily for customer-initiated communication. Customers may text our main business number to ask questions, request information, or coordinate their project. We may send outbound text messages from this number only for the following purposes:

Appointment scheduling, confirmations, and reminders (for templating, installation, or other site visits)
Job status updates during your project (such as templating completed, fabrication underway, or installation scheduled)
Direct replies to messages you send us

We do not send promotional, marketing, or advertising text messages from our main business number.

Message Frequency. Message frequency on our main business number varies and depends on your project and your interactions with us. During an active project, you may receive a small number of messages from this number. Outside of an active project, you should not expect to receive unsolicited messages from us.

Opt-In. By texting us, providing your mobile number on a form, or otherwise giving us your mobile number in connection with a project, you consent to receive text messages from Innovative Stone related to your inquiry or project. Consent to receive text messages is not a condition of purchasing any goods or services from us.

Opt-Out (STOP). You can opt out of receiving text messages from us at any time by replying STOP to any message we send you. After you reply STOP, we will send you a confirmation message and will not send you further text messages, except as required to confirm your opt-out. If you opt out, you may still need to contact us by phone or email to coordinate your project.

Message and Data Rates. Message and data rates may apply to any messages you send to or receive from us. Check with your mobile carrier for details about your plan.

5. Estimates, Quotes, and Project Agreements

Estimates and quotes are not binding contracts. Any estimate, quote, ballpark figure, or pricing information we provide — whether through our website, by text, by email, by phone, or in person — is provided for informational purposes and is subject to change based on actual measurements taken during templating, your final material and edge selections, slab availability, site conditions, and other factors.

Your project will be governed by a separate written contract. Any actual fabrication or installation work we perform for you will be governed by a separate written project agreement signed by both you and Innovative Stone. That signed agreement, not these Terms or any informal communication, governs the scope of work, pricing, payment terms, warranty, and other details of your project.

Photos and project information. When you send us photos, measurements, or other project information through our Site, by email, or by text, you give us permission to use that information to prepare your estimate and complete your project.

6. Natural Stone Disclosure

Natural stone (granite, marble, quartzite, soapstone, and similar materials) is a product of nature. Variations in color, pattern, veining, fissures, pitting, and texture are inherent characteristics of natural stone and are not defects. Photographs of stone slabs and finished projects on our Site are representative; the slabs we ultimately fabricate for your project may vary. We make every reasonable effort to help you understand and select the specific slabs used in your project.

Engineered (manufactured) quartz products are subject to their respective manufacturers’ specifications and warranties.

7. Disclaimers

The Site and its content are provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. Information on the Site is provided for general informational purposes and is not professional advice for any specific project.

Nothing in these Terms limits any warranties or rights provided in your signed project agreement with us, or any rights you have under California consumer protection laws.

8. Limitation of Liability

To the fullest extent permitted by law, Innovative Stone is not liable for any indirect, incidental, consequential, or special damages arising out of or related to your use of the Site, including loss of data or profits, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from your use of the Site is limited to one hundred dollars ($100).

This limitation does not apply to liability that cannot be limited under California law, and does not affect rights or obligations under any signed project agreement between you and Innovative Stone.

9. Third-Party Links

Our Site may include links to third-party websites or services that we don’t control. We provide these links for convenience and are not responsible for the content, privacy practices, or terms of any third-party site.

10. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any dispute arising out of or related to these Terms or your use of the Site will be resolved in the state or federal courts located in Placer County, California, and you consent to the jurisdiction of those courts.
